When Platform Participation Extends Into Rights Over External Content
Platform participation can expand commercial reach, but the terms governing that participation may also affect how independently owned content is accessed and used. ORV-BBI-006 examines how platform agreements can extend beyond content published directly on a platform and influence rights associated with external websites, research, product information, and other digital assets.
Using Meta’s October 2026 Commercial Terms controversy as the case, the analysis separates ownership, contractual permission, technical access, platform dependence, and distribution value. It shows why a business can retain ownership of its content while still granting rights that affect how that content is accessed, processed, or incorporated into commercial services, and why the economic effect depends on the scope of those permissions and the business model behind the information asset.
